AN ACT TO AMEND SECTION 63-3-1009, MISSISSIPPI CODE OF 1972, TO REQUIRE PLACEMENT OF STOP SIGNS AT ALL UNREGULATED RAILROAD CROSSINGS; TO REQUIRE VEHICLES TO STOP IN OBEDIENCE TO SUCH STOP SIGNS; TO PROVIDE A PENALTY FOR NONCOMPLIANCE; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 63-3-1009, Mississippi Code of 1972, is amended as follows:

63-3-1009. (1) The Transportation Commission shall * * * erect stop signs at all otherwise unregulated highway grade crossings of railroads. When such stop signs are erected the driver of any vehicle shall stop within fifty feet but not less than ten feet from the nearest track of such grade crossing and shall proceed only upon exercise of due care. No stop need be made at any such crossing where a police officer or a traffic control signal directs traffic to proceed.

(2) Violation of this section shall be a misdemeanor punishable upon conviction by a fine of Two Hundred Dollars ($200.00).

SECTION 2. This act shall take effect and be in force from and after July 1, 2000.
