AN ACT TO AMEND SECTION 97-21-33, MISSISSIPPI CODE OF 1972, TO REVISE THE PENALTY FOR FRAUDULENT ACKNOWLEDGMENT BY A NOTARY WHEN CONVICTED OF FORGERY THEREFOR; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 97-21-33, Mississippi Code of 1972, is amended as follows:
97-21-33. Persons convicted of forgery shall be punished by imprisonment in the penitentiary for a term of not less than two (2) years nor more than fifteen (15) years; provided, however, that when the amount of value involved is less than one hundred dollars ($100.00) in lieu of the punishment above provided for, the person convicted may be punished by imprisonment in the county jail for a term of not more than twelve (12) months, within the discretion of the court; provided further, that when the conviction is for fraudulent acknowledgment by a notary public, the sentence shall be for imprisonment in the penitentiary for a term of not more than three (3) years.
SECTION 2. This act shall take effect and be in force from and after July 1, 2000.
