AN ACT TO AMEND SECTION 97-3-25, MISSISSIPPI CODE OF 1972, TO PROVIDE SENTENCING ALTERNATIVES IN A MANSLAUGHTER CONVICTION; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 97-3-25, Mississippi Code of 1972, is amended as follows:

97-3-25. (1) Any person convicted of manslaughter shall be fined in a sum not less than Five Hundred Dollars ($500.00), or imprisoned in the county jail not more than one (1) year, or both, or in the penitentiary not less than two (2) years, nor more than twenty (20) years.

(2) In a conviction for manslaughter by culpable negligence, the sentencing judge, in his discretion, may designate the defendant as a violent or nonviolent offender according to the proof of the case.

SECTION 2. This act shall take effect and be in force from and after its passage.
