AN ACT TO CREATE A NEW CODE SECTION TO BE CODIFIED AS SECTION 63-7-40, MISSISSIPPI CODE OF 1972, TO PROHIBIT VEHICLES FROM BEING EQUIPPED WITH OR VEHICLE OPERATORS FROM USING LAMPS OR LIGHTING DEVICES DESIGNED TO BE USED OR USED TO SHINE IN, ON OR UPON ANOTHER PASSING VEHICLE OR ITS PASSENGERS; TO PRESCRIBE A PENALTY FOR VIOLATIONS THEREOF; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following shall be codified as Section 63-7-40, Mississippi Code of 1972:
63-7-40. (1) No truck, tractor, semitrailer or other vehicle may be equipped with, and no vehicle operator may use, any spot lamp, flood lamp or other lighting device that is designed to be used or is actually used for the purpose of shinning in, on or upon another passing vehicle or the operator or passengers of another passing vehicle.
(2) Any person who violates the provisions of subsection (1) of this section is guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not more than Two Hundred Fifty Dollars ($250.00).
SECTION 2. This act shall take effect and be in force from and after July 1, 2000.
