AN ACT TO REQUIRE THE BOARD OF SUPERVISORS OF EVERY COUNTY TO ADOPT SUCH ORDINANCES OR REGULATIONS AS MAY BE NECESSARY TO REGULATE THE MINIMUM ALTITUDE OF AIR TRAFFIC OVER REAL PROPERTY ADJACENT TO PRIVATE AIRPORTS OR TO REQUIRE THE OWNERS OF PRIVATE AIRPORTS TO OBTAIN AN EASEMENT FROM ADJOINING PROPERTY OWNERS IN ORDER TO OPERATE BELOW FIVE HUNDRED FEET; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The board of supervisors of every county shall adopt such ordinances or regulations as may be necessary to regulate the minimum altitude that air traffic must maintain over land and real property surrounding and adjacent to private airports within the county. However, such ordinances or regulations must provide that such air traffic shall maintain a minimum altitude of five hundred (500) feet over property immediately adjacent to private airports or that the owners or governing authorities of such airport must obtain an easement from the adjoining property owners in order to operate below five hundred (500) feet.
(2) None of the provisions of this section shall be construed as granting to a board of supervisors any power or authority that is prohibited by or that is in conflict with any law of the United States or any rule or regulation of any department, board, commission or agency of the United States.
SECTION 2. This act shall take effect and be in force from and after July 1, 2000.
