AN ACT TO AMEND SECTION 63-1-5, MISSISSIPPI CODE OF 1972, TO REQUIRE ACTUAL PHYSICAL POSSESSION OF A DRIVER'S LICENSE AT ALL TIMES WHEN DRIVING; TO REQUIRE IMMEDIATE ARREST OF VIOLATORS; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

 

SECTION 1. Section 63-1-5, Mississippi Code of 1972, is amended as follows:

63-1-5. (1) No person shall drive or operate a motor vehicle other than a motorcycle upon the highways of the State of Mississippi without first securing and having in his immediate possession while driving an operator's license to drive on the highways of the state, except those persons especially exempted by Section 63-1-7. Any person found to be in violation of this section shall be immediately arrested and jailed pending trial on such charge.

(2) Any person convicted of violation of this section who has not secured an operator's license to drive on the highways of this state prior to his arrest shall be punished as provided in Section 63-1-69 for a violation of this chapter.

SECTION 2. This act shall take effect and be in force from and after July 1, 1998.
