AN ACT TO AMEND SECTION 99-5-3, MISSISSIPPI CODE OF 1972, TO REVISE THE FORM OF BAIL; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 99-5-3, Mississippi Code of 1972, is amended as follows:
99-5-3. Bail taken in open court may be entered on the minutes as follows, to wit:
"The State
v. No. __________
__________, Defendant
"Came the said defendant, __________, and the defendant acting as the sureties, agreed to pay the State of Mississippi __________ Dollars, unless the said defendant shall appear at the present term of this court, and remain from day to day, and from term to term until discharged by law, to answer a charge of __________.
Signed ____________________
Approved _____________________
___________________________."
When the bail is for appearance before any committing court or a judge, the form may be varied to suit the condition.
These procedures shall be followed by all the Mississippi courts, whether Supreme, Court of Appeals, circuit, county, justice, municipal or other court to provide for release of Defendants on bail.
SECTION 2. This act shall take effect and be in force from and after July 1, 1998.
