AN ACT TO REQUIRE STATE AGENCIES TO DESIGNATE A CLOSING DATE FOR THE RECEIPT OF APPLICATIONS FOR STATE SERVICE POSITIONS; TO PROVIDE THAT NEITHER THE AGENCY NOR STATE PERSONNEL BOARD MAY REMOVE THE POSITION FROM RECRUITMENT BEFORE THE CLOSING DATE UNLESS EMERGENCY CIRCUMSTANCES REQUIRE OTHERWISE; TO PROVIDE THAT AGENCIES MAY EXTEND THE ORIGINAL CLOSING DATE DESIGNATED FOR POSITIONS; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Whenever a state agency announces the recruitment of applicants for a state service position, the agency shall designate a date certain which shall be the closing date for the receipt of applications for the position. Once the position has been placed on recruitment, applications for the position must be received until the closing date. Neither the agency nor the State Personnel Board may elect to take the position off recruitment before the designated closing date unless emergency circumstances require the earlier removal of the position from recruitment. If a position is taken off recruitment before the designated closing date due to emergency circumstances, the State Personnel Board immediately shall advertise the revised closing date at all locations at which recruitment for the position has been announced and in all publications in which the position has been advertised. This section shall not prohibit any agency from extending the original closing date designated for the receipt of applications for a position.

SECTION 2. Section 1 of this act shall be codified as a separate section in Chapter 9, Title 25, Mississippi Code of 1972.

SECTION 3. This act shall take effect and be in force from and after July 1, 1998.
