AN ACT TO CREATE A NEW CODE SECTION TO BE CODIFIED AS SECTION 37-138-10, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE COMMISSION ON ENVIRONMENTAL QUALITY TO ESTABLISH AN ASBESTOS INSPECTION AND RESPONSE ACTION PROGRAM FOR CERTAIN SCHOOL BUILDINGS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: SECTION 1. The following shall be codified as Section 37-138-10, Mississippi Code of 1972:
37-138-10. (1) The commission subject to the availability of funds appropriated by the Legislature or funds otherwise provided shall establish a program to provide for the:
(a) Inspection of asbestos containing material in public and private elementary and secondary school buildings;
(b) Implementation of appropriate response actions, where necessary; and
(c) Reinspection of school buildings on a periodic basis.
(2) Rules and regulations adopted by the commission to implement this program shall be equivalent to those promulgated by the United States Environmental Protection Agency for that purpose.
SECTION 2. This act shall take effect and be in force from and after July 1, 1997.
