AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO ENTER INTO AN AGREEMENT WITH THE BOARD OF SUPERVISORS OF PANOLA COUNTY TO EXCHANGE A PARCEL OF LAND OWNED BY THE STATE OF MISSISSIPPI FOR A PARCEL OF LAND OWNED BY PANOLA COUNTY, BOTH PARCELS BEING LOCATED IN THE CITY OF BATESVILLE, PANOLA COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The Mississippi Forestry Commission, through the Department of Finance and Administration and upon meeting the requirements of Section 29-1-1, may enter into an agreement with the board of supervisors of Panola County, to exchange a parcel of land owned by the Mississippi Forestry Commission, the parcel being located at Highway 35, North, Batesville, Panola County, Mississippi. For a parcel of land owned by Panola County, being located at MFC Fire Tower, Highway 6, East, Batesville, Panola County, Mississippi.
SECTION 2. The values of the parcels of land to be so exchanged shall be established by appraisal. The appraised value shall be determined by averaging three (3) separate appraisals for and on each parcel to be so exchanged. All of the appraisals must be rendered by three (3) Mississippi certified general appraisers selected by the Department of Finance and Administration. The cost of all of the appraisals on both parcels of land shall be borne equally by the State of Mississippi and Panola County. If the value of one parcel of land exceeds the value of the other parcel of land, the exchange shall be made without the payment of any difference in value by the State of Mississippi or by Panola County.
SECTION 3. The State of Mississippi shall retain all mineral rights to the state-owned real property exchanged pursuant to this act.
SECTION 4. This act shall take effect and be in force from and after its passage.
