Title: AN ACT TO CREATE THE CRIME VICTIMS' BILL OF RIGHTS; TO SPECIFY THE RIGHTS OF VICTIMS OF CERTAIN CRIMES; TO ENACT DEFINITIONS; TO SPECIFY THE PARTY TO EXERCISE THE VICTIM'S RIGHTS IN THE EVENT OF THE VICTIM'S DEATH OR INCAPACITY; TO REQUIRE LAW ENFORCEMENT AGENCIES TO PROVIDE VICTIMS WITH INFORMATION CONCERNING SERVICES AND COMPENSATION BENEFITS; TO REQUIRE THE PROSECUTING ATTORNEY TO NOTIFY THE VICTIM OF CHARGES AND PROCEEDINGS; TO ALLOW VICTIMS TO REQUEST NOTIFICATION; TO REQUIRE THE PROSECUTING ATTORNEY TO CONFER WITH THE VICTIM PRIOR TO FINAL DISPOSITION OF THE OFFENSE; TO PROVIDE THAT THE VICTIM DOES NOT HAVE THE RIGHT TO DIRECT THE PROSECUTION OF THE CASE; TO PROVIDE THAT THE VICTIM HAS THE RIGHT TO BE PRESENT THROUGHOUT CRIMINAL PROCEEDINGS; TO PROVIDE FOR MINIMIZATION OF CONTACT OF VICTIM WITH DEFENDANT; TO PROVIDE CONFIDENTIALITY OF CERTAIN INFORMATION ABOUT THE VICTIM; TO PROVIDE FOR THE VICTIM'S PRESENCE DURING PLEA AGREEMENT NEGOTIATION; TO PROVIDE FOR THE RIGHT TO PRE-SENTENCE INFORMATION; TO PROVIDE THAT THE VICTIM MAY SUBMIT A WRITTEN OR ORAL IMPACT STATEMENT; TO PROVIDE THAT THE VICTIM HAS THE RIGHT TO PRESENT EVIDENCE DURING PRE-SENTENCING, SENTENCING OR RESTITUTION PROCEEDINGS; TO SPECIFY THE INFORMATION TO WHICH THE VICTIM HAS A RIGHT; TO PROVIDE THAT THE EXERCISE OF THESE RIGHTS IS DISCRETIONARY WITH THE VICTIM; TO PROVIDE THE VICTIM WITH THE RIGHT TO RETURN OF PROPERTY; TO PROVIDE THE INFORMATION WHICH MUST BE PROVIDED TO A VICTIM UPON REQUEST BY ANY AGENCY HAVING PHYSICAL CUSTODY OF A PRISONER; TO PROVIDE FOR THE SUBMISSION OF THE VICTIM'S STATEMENT INTO A PRISONER'S RECORDS; TO PROTECT THE EMPLOYMENT OF A VICTIM WHO IS SUBPOENAED TO TESTIFY; TO PROVIDE THAT THE ATTORNEY GENERAL OR DISTRICT ATTORNEY MAY ASSERT ANY RIGHT TO WHICH THE VICTIM IS ENTITLED; TO PROVIDE THAT FAILURE TO PROVIDE RIGHT OR NOTICE IS NOT GROUNDS FOR SETTING ASIDE SENTENCE; AND FOR RELATED PURPOSES.
