A CONCURRENT RESOLUTION PROPOSING AMENDMENTS TO SECTIONS 34, 35, 41 AND 42, MISSISSIPPI CONSTITUTION OF 1890, TO PROVIDE THAT A PERSON WHO IS ELECTED AFTER JULY 1, 2026, AND WHO HAS SERVED FOR THREE CONSECUTIVE FOUR-YEAR TERMS IN THE MISSISSIPPI HOUSE OF REPRESENTATIVES OR THE MISSISSIPPI SENATE SHALL NOT BE ELIGIBLE TO SERVE AGAIN IN THAT OFFICE.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI, That the following amendments to the Mississippi Constitution of 1890 are proposed to the qualified electors of the state:
I.
Amend Section 34, Mississippi Constitution of 1890, to read as follows:
"Section 34. The house of representatives shall consist of members chosen every four (4) years by the qualified electors of the several counties and representative districts. A person elected as a member of the House of Representatives is eligible to succeed himself or herself in office; however, after serving three (3) full and consecutive four-year terms in the House of Representatives, he or she shall not be eligible to serve again in that office. This limitation on the number of terms shall apply to terms of office beginning on or after July 1, 2026."
II.
Amend Section 35, Mississippi Constitution of 1890, to read as follows:
"Section 35. The senate shall consist of members chosen every four years by the qualified electors of the several districts. A person elected as a member of the Senate is eligible to succeed himself or herself in office; however, after serving three (3) full and consecutive four-year terms in the Senate, he or she shall not be eligible to serve again in that office. This limitation on the number of terms shall apply to terms of office beginning on or after July 1, 2026."
III.
Amend Section 41, Mississippi Constitution of 1890, to read as follows:
"Section 41. No person shall be a member of the House of Representatives who shall not have attained the age of twenty-one (21) years, and who shall not be a qualified elector of the state, and who shall not have been a resident citizen of the state for four (4) years, and within the district such person seeks to serve for two (2) years, immediately preceding his election, and who has reached the term limits defined in Section 34, Mississippi Constitution of 1890. The seat of a member of the House of Representatives shall be vacated on his removal from the district from which he was elected."
IV.
Amend Section 42, Mississippi Constitution of 1890, to read as follows:
"Section 42. No person shall be a senator who shall not have attained the age of twenty-five (25) years, who shall not have been a qualified elector of the state four (4) years, and who shall not be an actual resident of the district or territory he may be chosen to represent for two (2) years before his election, and who has reached the term limits defined in Section 35, Mississippi Constitution of 1890. The seat of a senator shall be vacated upon his removal from the district from which he was elected."
BE IT FURTHER RESOLVED, That these proposed amendments shall be submitted by the Secretary of State to the qualified electors at an election to be held on the first Tuesday after the first Monday of November 2026, as provided by Section 273 of the Constitution and by general law, with the amendments in this resolution being voted on as one (1) amendment since the proposed amendments pertain to one (1) subject.
BE IT FURTHER RESOLVED, That the explanation of this proposed amendment for the ballot shall read as follows: "This proposed constitutional amendment provides that a person who is elected after July 1, 2026, and who has served for three consecutive four-year terms in the Mississippi House of Representatives or the Mississippi Senate is not eligible to serve again in that office."
