AN ACT TO AMEND SECTION 41-137-61, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT A CERTAIN PERCENTAGE OF THE FEES AND FINES COLLECTED UNDER THE MISSISSIPPI MEDICAL CANNABIS ACT SHALL BE DEPOSITED INTO THE MISSISSIPPI PUBLIC HEALTH TRUST FUND FOR FOUR YEARS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 41-137-61, Mississippi Code of 1972, is amended as follows:

     [Until July 1, 2030, this section shall read as follows:]

     41-137-61.  Twelve and one-half percent (12-1/2%) of all fees and fines collected by the MDOR and MDOH according to the provisions of this chapter each year shall be deposited into the Mississippi Public Health Trust Fund created by Section 41-3-24 and the remainder of such fees and fines collected each year shall be deposited into the State General Fund.

     [From and after July 1, 2030, this section shall read as follows:]

     41-137-61.  All fees and fines collected by the MDOR and MDOH according to the provisions of this chapter shall be deposited into the State General Fund.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2026.
