AMENDMENT NO 1 TO COMMITTEE AMENDMENT NO 1 PROPOSED TO

House Bill No. 1502

     AMEND by inserting the following below line 3914:

(6)  The department shall not issue a new package retailer's permit for a location within one thousand five hundred (1,500) feet of an existing store with a valid package retailer's permit.  The distance shall be measured in a straight line from the primary front entrance of the proposed establishment to the primary front entrance of the existing package retailer.  This subsection (6) shall not apply to:

(a)  An application for the renewal of an existing package retailer's permit;

(b)  A transfer of ownership of a business already holding a valid package retailer's permit at the same location; or

(c)  A location which has been explicitly exempted from this restriction by a municipal or county ordinance.

FURTHER, AMEND the title to conform.
