AN ACT TO CREATE "JOSSELYN'S LAW"; TO PROHIBIT BAIL FOR ANY PERSON ARRESTED FOR CAPITAL MURDER; TO AUTHORIZE RELEASE IF FOUND NOT GUILTY IN A COURT OF LAW; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) This act shall be known and may be cited as "Josselyn's Law".
(2) (a) Bail shall not be allowable or otherwise authorized for any person who is arrested for capital murder as defined by Section 97-3-19. Such person shall remain in custody and shall not be released from custody, unless the person is found not guilty by a court of law.
(b) The provisions of this section shall be construed to prohibit any form of release by a court of law for any person who is arrested for capital murder as defined in Section 97-3-19.
SECTION 2. This act shall take effect and be in force from and after July 1, 2025.
