AN ACT TO AMEND SECTION 25-61-19, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT WITHIN SIXTY DAYS AFTER JULY 1, 2024, EACH AGENCY, DEPARTMENT AND INSTITUTION OF THE STATE OF MISSISSIPPI SHALL INCLUDE ON THE INTERNET WEBSITE OF THE AGENCY, DEPARTMENT OR INSTITUTION A SEPARATE SECTION THAT PROVIDES THE ORGANIZATIONAL STRUCTURE OF THE AGENCY, DEPARTMENT OR INSTITUTION; TO AMEND SECTION 25-1-117, MISSISSIPPI CODE OF 1972, TO PROVIDE FOR REGULAR REVIEW AND UPDATES, IF NECESSARY, TO THE ORGANIZATIONAL STRUCTURE INFORMATION THAT IS REQUIRED TO BE POSTED ON EACH AGENCY, DEPARTMENT AND INSTITUTION WEBSITE; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 25-61-19, Mississippi Code of 1972, is amended as follows:
25-61-19. (1) Within sixty (60) days after the end of each regular session of the Legislature, each agency or department of the State of Mississippi shall include on the Internet website of the agency or department a separate section that provides a legislative update on any legislation enacted at the legislative session that revises the powers and duties of the agency or department. The agency or department shall include a link to the legislative update section on the home page of the website. The legislative update section shall contain a summary of the revisions made to the powers and duties of the agency or department by the legislation, and a contact section or link so that members of the public may comment on or ask questions about the revisions or the effect of the revisions in the legislation. The legislative update section shall remain on the website of the agency or department until January 1 of the following year.
(2) Within sixty (60) days after July 1, 2024, each agency, department and institution of the State of Mississippi shall include on the Internet website of the agency, department or institution a separate section that provides the organizational structure of the agency, department or institution. Such information shall include the position within the agency, department or institution and the name of the person holding the position. Such information shall be updated as provided in Section 25-1-117.
SECTION 2. Section 25-1-117, Mississippi Code of 1972, is amended as follows:
25-1-117. Each state agency and each statewide elected official that provides information to the public about the agency or office on a website on the Internet shall review and update the information on the website on a regular basis, not less frequently than once a month, to ensure that the information appearing on the website is current and that outdated information has been removed or placed in a separate section of archived information. Each review and update shall also include the review and update, if necessary, of the organizational structure information required to be posted on each agency, department and institution website as provided in Section 25-61-19. Any change in structure or personnel to the organizational structure information required to be posted in Section 25-61-19 shall be updated not later than thirty (30) days after the change occurs.
SECTION 3. This act shall take effect and be in force from and after July 1, 2024.
