AN ACT TO CREATE NEW SECTION 41-60-34, MISSISSIPPI CODE OF 1972, TO ESTABLISH THE AUTOMATED EXTERNAL DEFIBRILLATORS IN PUBLIC PLACES GRANT PROGRAM TO BE ADMINISTERED BY THE DEPARTMENT OF HEALTH FOR THE PURPOSE OF PROVIDING FUNDS TO ENTITIES TO SUPPLY AEDS IN PUBLIC PLACES; TO REQUIRE THE DEPARTMENT TO PROMULGATE RULES AND REGULATIONS FOR THE PROGRAM; TO SET CERTAIN REQUIREMENTS OF THE PROGRAM; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following shall be codified as Section 41-60-34, Mississippi Code of 1972:
41-60-34. (1) There is hereby established the Automated External Defibrillators in Public Places Grant Program which shall be administered by the Department of Health for the purpose of providing funds to entities to supply AEDs in public places.
(2) For purposes of this section, "AED" shall mean an automated external defibrillator as defined in Section 41-60-31.
(3) For purposes of this section, "public place" shall mean any area to which the general public is invited or in which the general public is permitted, regardless of the ownership of the area, and any area owned or controlled by a municipality, county, school district or state agency. Such term shall not mean a private residential dwelling.
(4) The Department of Health shall administer the program with the intent to ensure the health and safety of citizens in public places. The Department of Health shall promulgate rules and regulations to accomplish the purpose of the program. The Department of Health shall establish criteria for applicants applying on behalf of a municipality, county, school district or state agency.
(5) Individual applicants shall provide the Department of Health proof of control or ownership of the public place to receive funds from the program.
SECTION 2. This act shall take effect and be in force from and after July 1, 2023.
