AN ACT TO AUTHORIZE COUNTIES TO DIRECTLY ALLOCATE CORONAVIRUS STATE AND LOCAL FISCAL RECOVERY FUNDS MADE AVAILABLE UNDER THE AMERICAN RESCUE PLAN ACT OF 2021 TO RURAL WATER ASSOCIATIONS AND MUNICIPALITIES FOR WATER AND SEWER INFRASTRUCTURE PROJECTS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The boards of supervisors of any county are hereby authorized to directly allocate Coronavirus State and Local Fiscal Recovery Funds made available under the federal American Rescue Plan Act of 2021 to rural water associations, and regional sewer utilities or districts for water and sewer infrastructure projects and to incorporated municipalities for water, sewer and storm water infrastructure projects.  If said water association or municipality spans two (2) or more counties, the majority of water meters for the water association or municipality must be located in the county allocating said funds.

     SECTION 2.  Section 1 of this act shall be codified in Title 19, Chapter 5, Mississippi Code of 1972.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2023, and shall stand repealed on June 30, 2023.
