AN ACT TO PROHIBIT A STATE AGENCY, DEPARTMENT, POLITICAL SUBDIVISION OF THIS STATE, COUNTY, MUNICIPALITY, UNIVERSITY, COLLEGE, COMMUNITY COLLEGE OR JUNIOR COLLEGE, OR ANY AGENT, EMPLOYEE OR OFFICER THEREOF FROM CREATING, PLANNING, IMPLEMENTING, ASSISTING, PARTICIPATING IN, OR ENABLING AN OVERSEAS POLICE SERVICE STATION IN LOCATING TO THIS STATE; TO PROVIDE THAT ANY POLICY ADOPTED OR ACTION TAKEN IN VIOLATION OF THIS ACT SHALL BE INVALID AND VOID, AND THE STATION SHALL BE CLOSED IMMEDIATELY BY LAW ENFORCEMENT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  No state agency, department, political subdivision of this state, county, municipality, university, college, community college or junior college, or any agent, employee or officer thereof shall create, plan, implement, assist, participate in, or enable any sanctuary policy.  For purposes of this section, "overseas police service station" means any center or location managed and/or controlled by any country that is not the United States for the purpose of monitoring the activities of that country's citizens.

     (2)  Any policies that support or regulate overseas police service stations in violation of this act shall be invalid and void upon enactment or adoption.  Any overseas police service station established in violation of this act shall be closed immediately by any law enforcement agency.

     (3)  Any state agency, department, political subdivision of this state, county, municipality, university, college, community college or junior college, or any agent, employee or officer thereof found in violation of this act shall be subject to a civil penalty of Twenty Thousand Dollars ($20,000.00) per day for each day that the overseas police service station exists.  In order to avoid a civil penalty under this section, the state agency, department, political subdivision of this state, county, municipality, university, college, community college or junior college, or any agent, employee or officer thereof shall take action to rescind the policy.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2023.
