AN ACT TO PROVIDE THAT MEMBERS OF THE LEGISLATURE HAVE INDIVIDUAL STANDING TO CHALLENGE CERTAIN ACTIONS OF THE GOVERNOR IN STATE COURT; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. A member of the Mississippi Legislature has individual standing to challenge the actions of the Governor in state court for either of the following actions taken by the Governor:
(a) Nullification of the member's individual vote by the veto or partial veto of a bill that the member voted in favor of; or
(b) Usurpation of any of the constitutional powers of the legislative branch that adversely impacts the member's individual powers or duties as a legislator.
SECTION 2. This act shall take effect and be in force from and after its passage.
