House Bill 479

AN ACT TO AUTHORIZE A PRESIDING JUDGE OF A CIVIL COURT PROCEEDING TO ASSESS ALL COSTS OF ANY DISMISSED CASE AGAINST THE PARTY WHOSE CASE WAS DISMISSED, UNLESS THE STATUTE OR RULES REGULATING THE SUBJECT MATTER OF THE CASE PROHIBITS SUCH ASSESSMENT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Any presiding judge of a civil court proceeding  is authorized, in his or her discretion, to assess all costs of any dismissed case against the party whose case was dismissed, unless the statute or rules regulating the subject matter of the case prohibits such.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2023.
