AN ACT TO AMEND SECTION 43-3-101, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE MISSISSIPPI INDUSTRIES FOR THE BLIND TO ENTER INTO AGREEMENTS AND CONTRACTS WITH DIFFERENT ENTITIES AND AGREE TO THE TERMS OF INDEMNIFICATION, THE LAW OF ANOTHER STATE OR JURISDICTION OR OTHER SUCH TERMS IF IT DETERMINES THAT THE AGREEMENTS AND CONTRACTS WOULD BE IN ITS BEST INTERESTS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 43-3-101, Mississippi Code of 1972, is amended as follows:

     43-3-101.  (1)  There is hereby created and established an agency of the State of Mississippi known as the Mississippi Industries for the Blind, hereinafter referred to as the "MIB."  The MIB shall be a body politic and corporate, may acquire and hold real and personal property, may receive, hold and disperse monies appropriated to it by the Legislature of the State of Mississippi received from the federal government, received from the sale of products which it produces, and received from any other sources whatsoever, and may sue and be sued in its name.  The MIB is authorized and empowered to establish nonprofit entities for the purpose of defraying costs incurred in the performance of the MIB's purpose and responsibilities.

     (2)  The MIB may enter into agreements with federal, state, public or private agencies, departments, institutions, firms, corporations or persons that the MIB determines are in its best interests.  The MIB may enter into any contracts and other agreements necessary for those purposes, and in doing so, the MIB may agree to terms of indemnification, the law of another state or jurisdiction or other necessary terms when, in the judgment of the MIB, that decision is in its best interest.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
