AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF BALDWYN, MISSISSIPPI, TO EXPAND AND OPERATE ITS NATURAL GAS DISTRIBUTION SYSTEM WITHIN A CERTAIN AREA OUTSIDE THE CORPORATE LIMITS IN ORDER TO PROVIDE GAS SERVICE TO UNDERSERVED AREAS OF TIPPAH COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The governing authorities of the City of Baldwyn, in Lee and Prentiss Counties, Mississippi, in their discretion, may construct, expand, operate and maintain the gas system of the City of Baldwyn for a distance of beyond five (5) miles from the corporate limits in the following service area located in Tippah County, Mississippi:

From the POINT OF BEGINNING which is a point on the boundary of the City of Baldwyn's existing certificated gas service area and the intersection of the Tippah/Prentiss County Line, located in the Southeast Quarter of Section 24, Township 5 South, Range 5 East; thence,

l)   West for a distance of 1/2 mile along said

     boundary; thence,

2)   North for a distance of 1/8 mile along said

     boundary; thence,

3)   West for a distance of approximately 2,400 feet

     along said boundary; thence,

4)   North for a distance of approximately 400 feet

     along said boundary; thence,

5)   West for a distance of approximately 500 feet along

     said boundary; thence,

6)   North for a distance of approximately 400 feet

     along said boundary; thence,

7)   West for a distance of 1/8 mile along said

     boundary; thence,

8)   North for a distance of 1/8 mile along said

     boundary; thence,

9)   West for a distance of approximately 1,500 feet

     along said boundary; thence,

10)  North for a distance of 1/8 mile along said

     boundary; thence,

11)  Leaving said service area boundary, continue North

     for a distance of approximately 1,500 feet to the

     intersection of the North Section Line of Section

     23, Township 5 South, Range 5 East; thence,

12)  Continue North for a distance of 1/4 mile; thence,

13)  East for a distance of 3/4 mile to the Northeast

     Corner of the Southwest Quarter of the Southwest

     Quarter of Section 13, Township 5 South, Range 5

     East; thence,

14)  South for a distance of 1/2 mile to the Southeast

     Corner of the Northwest Quarter of the Northwest

     Quarter of Section 24; thence,

15)  East for a distance of 3/4 mile to the intersection

     of the Tippah/Prentiss County Line; thence,

16)  South along the Tippah/Prentiss County Line for a

     distance of approximately 3,100 feet to the

     intersection of the existing Gas Certificated Area

     Boundary and the POINT OF BEGINNING.

     (2)  The authority conferred by this act shall not be construed as an exemption from the provisions of Section 77-3-1 et seq., Mississippi Code of 1972, as to the requirements for obtaining a certificate of public convenience and necessity, the jurisdiction of the Public Service Commission to regulate rates or any other provisions of that law.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
