AN ACT TO CREATE NEW SECTION 3-3-16, MISSISSIPPI CODE OF 1972, TO ADOPT AS THE OFFICIAL STATE FLAG THE DESIGN RECOMMENDED BY THE COMMISSION TO REDESIGN THE MISSISSIPPI STATE FLAG AND APPROVED BY 72% OF THE QUALIFIED ELECTORS VOTING IN THE STATEWIDE SPECIAL ELECTION HELD ON NOVEMBER 3, 2020; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The following shall be codified as Section 3-3-16, Mississippi Code of 1972:

     3-3-16.  (1)  The design of the state flag recommended by the Commission to Redesign the Mississippi State Flag and approved by seventy-two percent (72%) of the qualified electors voting in the statewide special election held on November 3, 2020, is adopted as the official state flag.  The design of the state flag shall be as follows:

     A white magnolia flower centered on an Old Glory Blue banner; two (2) vertical Old Glory Red bars on the fly end and hoist end; two (2) narrow vertical Old Gold bars separating the blue center from the red bars; the magnolia shall be encircled by twenty (20) white five-point stars signifying Mississippi as the twentieth state; a larger gold segmented five-point star shall sit atop the circle representing indigenous Native Americans who inhabited the Mississippi region prior to statehood; the bottom of the circle of stars shall be completed by the words "IN GOD WE TRUST" in capital letters; the proportions shall be as follows:  the flag shall be seventy-two (72) vertical units to one hundred twenty (120) horizontal units, with the red bars being twenty-five (25) horizontal units, the gold bars being five (5) horizontal units, the blue center being sixty (60) horizontal units, and the artwork being forty-eight (48) vertical units.  The official size is 3 X 5 feet, but variable.  The font is Americana.

     (2)  The Secretary of State shall be the custodian of the official state flag.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
