AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF TALLAHATCHIE COUNTY, MISSISSIPPI, TO LEASE TO THE CITY OF CHARLESTON, MISSISSIPPI, A CERTAIN WATER WELL; TO PROVIDE THAT SUCH LEASE MAY BE ENTERED INTO FOR A PERIOD OF UP TO 25 YEARS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Board of Supervisors of Tallahatchie County, Mississippi, may, in its discretion, lease the water well on or near the Tallahatchie County Industrial Park located north of Highway 32 in the First Judicial District of Tallahatchie County, Mississippi, for a period of up to twenty-five (25) years on such terms as the board of supervisors deems would best promote the public safety, economic development and/or public welfare of the City of Charleston, Mississippi, and the rest of Tallahatchie County, Mississippi.

     (2)  In the execution of the lease authorized under this section, it shall be provided that the rate to be charged for water usage and fire protection usage to industries, businesses, or public entities located in the Tallahatchie County Industrial Park shall be no higher than that agreed to by both the Board of Supervisors of Tallahatchie County and the governing authorities of the City of Charleston during the terms of the lease agreement.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
