House Bill 1418

AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE OAKLAND/YALOBUSHA NATURAL GAS DISTRICT TO EXPAND ITS GAS DISTRIBUTION SYSTEM; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The governing authorities of the Oakland/Yalobusha Natural Gas District in their discretion, may construct, expand, operate and maintain the gas system of the Oakland/Yalobusha Natural Gas District in the following described area:

That portion of Township 25 North, Range 3 East south of Mississippi Highway 32 and that portion, as well as Township 24 North, Range 3 East in the First Judicial District of Tallahatchie County, Mississippi, which are not certified by the Public Commission to any natural gas supplier.

     (2)  The authority granted under this act shall be in addition to the areas currently authorized for gas service by the natural gas district in Yalobusha County and Tallahatchie County.

     (3)  The authority conferred by this act shall not be construed as an exemption from the provisions of Section 77-3-1 et seq., Mississippi Code of 1972, as to the requirements for obtaining a Certificate of Public Convenience and Necessity, the jurisdiction of the Public Service Commission to regulate rates or any other provisions of that law.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
