AN ACT TO AMEND SECTION 89-7-33, MISSISSIPPI CODE OF 1972, TO REVISE THE LANDLORD TENANT PROVISIONS BY CLARIFYING THAT A SUMMONS IS ONLY REQUIRED TO BE PLACED IN SOME CONSPICUOUS PLACE ON THE PREMISES WHERE THE TENANT LAST RESIDED, WHEN THE TENANT CANNOT BE FOUND; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 89-7-33, Mississippi Code of 1972, is amended as follows:

     89-7-33.  Such summons shall be served as a summons is served in other cases, if the tenant can be found; if not, then * * *by putting up a copy of the summons shall only be required to be placed in some conspicuous place on the premises where the tenant last or usually resided, but under no circumstances shall the summons be required to be mailed.

     The provisions of this section shall supersede the provisions of any court rule, regulation or order to the extent that any conflict exists.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2021.
