AN ACT TO AMEND SECTION 37-11-13, MISSISSIPPI CODE OF 1972, TO REQUIRE ALL PUBLIC AND PRIVATE SCHOOL EMPLOYEES TO BE TESTED ANNUALLY FOR TUBERCULOSIS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 37-11-13, Mississippi Code of 1972, is amended as follows:

     37-11-13.  (1)  Beginning in the 2021-2022 school year, the school board of each local school district, the governing board of each charter school and the governing board of each private school shall require all employees, both licensed and nonlicensed, to be tested annually for tuberculosis.  A newly hired employee must be tested for tuberculosis upon employment; all other employees must be tested no later than October 1 of each year.  Each employee shall submit documentation verifying that the person has been tested for tuberculosis to the superintendent of the school district or, in the case of a charter school or private school, the person designated by the governing board to receive the documentation before October 1 of each year.  The school board of each local school district and the governing board of each charter school and private school shall take such steps as may be necessary to assure implementation of the requirements of this section.

     (2)  No person suffering from tuberculosis in an infectious or communicable stage will be employed in any school in this state, public or private * * *, as an administrator, teacher, secretary, janitor, cook in lunchroom, bus driver, or in any other capacity.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2021.
