AN ACT TO PROVIDE FOR CERTAIN TRANSFERS TO THE BUDGET CONTINGENCY FUND DURING FISCAL YEAR 2021; TO AMEND SECTION 1 OF CHAPTER 484, LAWS OF 2020, TO CHANGE TO DECEMBER 15, 2020, THE DATE BY WHICH FUNDS MAY BE EXPENDED FOR CERTAIN PROGRAMS BEFORE BEING TRANSFERRED TO THE UNEMPLOYMENT COMPENSATION FUND; TO INCLUDE OTHER BILLS AND SPECIAL FUNDS IN THE LIST OF THOSE WHOSE FUNDS WILL BE TRANSFERRED TO THE UNEMPLOYMENT COMPENSATION FUND IF THEY ARE NOT EXPENDED BY DECEMBER 15, 2020; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  During Fiscal Year 2021, the State Fiscal Officer shall transfer to the Budget Contingency Fund out of the following enumerated funds, the amounts listed below from each fund:

     SECTION 2.  Section 1 of Chapter 484, Laws of 2020 (House Bill No. 1805, 2020 Regular Session), is amended as follows:

     Section 1.  (1)  If any of the funds appropriated from the Budget Contingency Fund under House Bill Numbers 1728, 1749, 1750, 1751, 1752, 1782, 1789, 1795 * * * and, 1799, 1808, 1812 and 1813 and Senate Bill Numbers 3011, 3012, 3013 * * * and, 3014, 3059 and 3063, 2020 Regular Session, have not been expended by December * * *2815, 2020, or if at any time the entity to which those funds were appropriated determines that any of those funds are ineligible to be spent by the entity, then the State Fiscal Officer shall transfer any unexpended funds remaining from those appropriations, or the funds determined to be ineligible, into the Unemployment Compensation Fund not later than December 30, 2020.

     (2)  If any of the funds appropriated from the DFA Cares Act COVID-19 Fund, Mississippi Tourism Recovery Fund, Mississippi Nonprofit Art Museums Recovery Fund, Equity in Distance Learning Fund, Postsecondary Education COVID-19 Mitigation Relief Grant Fund, Independent Schools' COVID-19 Assistance Grant Fund, Mississippi Pandemic Response Broadband Availability Grant Program Fund, Mississippi Emergency Management Agency COVID-19 Fund, Mississippi Electric Cooperatives Broadband COVID-19 Grant Program Fund * * * or, COVID-19 Broadband Provider Grant Program Fund, Rental Assistance Grant Program Fund, ICU Infrastructure Fund, Poultry Farmer Stabilization Grant Program Fund, Mississippi Supplemental CFAP Grant Program Fund or Sweet Potato Farm Sustainment Grant Program Fund under House Bill Numbers 1752, 1790, 1792, 1794, 1797, 1799 * * * and, 1800 and 1809 and Senate Bill Numbers 3014, 3060 and 3061, 2020 Regular Session, or any of the funds escalated under the provisions of subsection (3) or (4) of Section 1 of Senate Bill No. 2772, 2020 Regular Session, as amended by Section 1 of Senate Bill No. 3053, as amended by Section 1 of House Bill No. 1811, have not been expended by December * * *2815, 2020, or if at any time the entity to which those funds were appropriated determines that any of those funds are ineligible to be spent by the entity, then the State Fiscal Officer shall transfer any unexpended funds remaining from those appropriations or escalations, or the funds determined to be ineligible, into the Unemployment Compensation Fund not later than December 30, 2020.

     (3)  The provisions of this section shall supersede the provisions of * * *Section 2 of House Bill No. 1784, Section 8 of Senate Bill No. 3044 * * *,; Section 3(3) of House Bill No. 1788 * * *,; Section 3(2) and Section 4(1) of House Bill No. 1791 * * *,; Sections 5 and * * *1311 of House Bill No. 1793, as amended by Section 4 of House Bill No. 1811; Sections 4 and 9 of Senate Bill No. 2772, as amended by Section 1 of Senate Bill No. 3053, as amended by Sections 1 and 2 of House Bill No. 1811; Section 3 of Senate Bill No. 3046 * * *,; Section 6(2) of Senate Bill No. 3047, as amended by Section 3 of House Bill No. 1811, 2020 Regular Session, to the extent of any conflict between those provisions and this section.

     (4)  If there are any unexpended funds in the Budget Contingency Fund on December 15, 2020, that were not appropriated or escalated under any bill listed in this section, the State Fiscal Officer shall transfer the balance of those unexpended funds into the Unemployment Compensation Fund not later than December 30, 2020.

     SECTION 3.  This act shall take effect and be in force from and after its passage.
