AN ACT TO AMEND SECTION 41-59-7, MISSISSIPPI CODE OF 1972, TO RECONSTITUTE THE MEMBERSHIP OF THE EMERGENCY MEDICAL SERVICES ADVISORY COUNCIL AND THE MISSISSIPPI TRAUMA ADVISORY COMMITTEE; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 41-59-7, Mississippi Code of 1972, is amended as follows:
41-59-7.
(1) There is created an Emergency Medical Services Advisory Council. * * * On July 1, 2020, the terms of the members
serving on the advisory council shall expire, and the advisory council shall be
reconstituted to consist of the following members, who shall be
appointed by the * * *
State Health Officer:
(a)
One (1) * * * operator of a private Mississippi licensed EMS
agency;
(b)
One (1) licensed physician to be appointed from a list of nominees who are
actively engaged in rendering emergency medical services * * *
as an offline medical director;
(c)
One (1) * * * operator of a fire based (career) Mississippi
licensed transport EMS agency;
(d)
* * * One
(1) operator of a hospital based Mississippi licensed EMS agency;
(e)
* * * One (1)
operator of an air medical Mississippi licensed EMS agency;
(f)
* * *
One (1) official of county or municipal government;
(g) One (1) licensed physician to be appointed from a list of nominees presented by the Mississippi Chapter of the American College of Emergency Physicians;
(h)
One (1) representative from * * * the Mississippi EMT Association to be appointed by
the association's governing body;
(i)
One (1) * * * licensed physician to be appointed from a list of
nominees presented by the Mississippi Chapter of the American College of
Pediatrics;
(j) One (1) EMT-Paramedic whose employer renders emergency medical services in a designated trauma care region;
(k)
One (1) * * * Mississippi EMS educator approved by BEMS to
provide EMS training;
(l)
One (1) member who shall be a person who has been a recipient of * * * EMS care in Mississippi or who
has an immediate family member who has been a recipient of * * * EMS care in Mississippi;
* * *
( * * *m) One (1) representative from the
Mississippians for Emergency Medical Services, to be appointed by the
association's governing body * * *; and
(n) One (1) member of the Trauma Advisory Committee.
The
initial terms of the members of the reconstituted advisory
council * * *
shall begin on July 1, * * *
2020. * * *
Seven (7) members shall be appointed for a term of two (2) years, * * * and seven (7) members shall be
appointed for a term of three (3) years * * *. Thereafter, members shall be appointed for a term
of four (4) years from the expiration date of the previous term. The * * * State Health Officer or his
designated representative shall serve as ex officio chairman of the advisory
council. Advisory council members may hold over and shall continue to serve
until a replacement is named by the * * * State Health Officer.
The advisory council shall meet at the call of the chairman at least annually. For attendance at such meetings, the members of the advisory council shall be reimbursed for their actual and necessary expenses including food, lodging and mileage as authorized by law, and they shall be paid per diem compensation authorized under Section 25-3-69.
The
advisory council shall advise and make recommendations to the board regarding
rules and regulations promulgated * * * under this chapter.
(2)
There is created a committee * * *
to be named the Mississippi Trauma Advisory Committee * * *. This
committee shall act as the advisory body for trauma care system development and
provide technical support to the department in all areas of trauma care system
design, trauma standards, data collection and evaluation, continuous quality
improvement, trauma care system funding, and evaluation of the trauma care
system and trauma care programs. The membership of the Mississippi Trauma
Advisory Committee shall be comprised of * * * the following members who shall be
appointed by the State Health Officer:
(a) One (1) licensed physician to be appointed from a list of nominees presented by the Mississippi Trauma Committee, American College of Surgeons;
(b) One (1) licensed physician to be appointed from a list of nominees presented by the Mississippi Chapter of the American College of Emergency Physicians;
(c) One (1) licensed neurosurgeon to be appointed from a list of nominees presented by the Mississippi State Medical Association;
(d) One (1) licensed physician involved in the care of pediatric trauma patients to be appointed from a list of nominees presented by the Mississippi Chapter of the American College of Pediatrics;
(e) One (1) trauma surgeon, trauma program nurse or trauma registrar representative from one (1) in-state Level 1 trauma center to be appointed from a list of nominees submitted by in-state Level 1 trauma centers;
(f) One (1) trauma surgeon, trauma program nurse or trauma registrar representative from one (1) designated out-of-state participating Level 1 trauma center to be appointed from a list of nominees submitted by out-of-state trauma centers;
(g) One (1) trauma surgeon, trauma program nurse or trauma registrar representative from one (1) designated Level 2 trauma center to be appointed from a list of nominees submitted by Level 2 trauma centers;
(h) One (1) trauma surgeon, trauma program nurse or trauma registrar representative from one (1) designated Level 3 trauma center or burn center to be appointed from a list of nominees submitted by Level 3 trauma centers and burn centers;
(i) One (1) trauma surgeon, trauma program nurse or trauma registrar representative from one (1) designated Level 4 trauma center to be appointed from a list of nominees submitted by Level 4 trauma centers;
(j) One (1) registered nurse to be appointed from a list of nominees submitted by the Mississippi Emergency Nurses Association;
(k) One (1) registered nurse whose employer renders emergency services to be appointed from a list of nominees presented by the Mississippi Nurses Association;
(l) Two (2) hospital administrators who are employees of hospitals that provide emergency services to be appointed from a list of nominees presented by the Mississippi Hospital Association;
(m) One (1) representative from the EMS Advisory Council;
(n) One (1) certified paramedic appointed from a list of nominees presented by Mississippians for Emergency Medical Services;
(o) One (1) certified paramedic appointed from a list of nominees presented by the Mississippi EMT Association; and
(p) One (1) representative from the Department of Rehabilitation Services to be appointed from a list of nominees presented by Department of Rehabilitation Services.
The initial terms of the advisory committee members shall begin on July 1, 2020. Nine (9) members shall be appointed for a term of two (2) years and eight (8) members shall be appointed for a term of three (3) years. Thereafter, members shall be appointed for a term of four (4) years from the expiration date of the previous term. The State Health Officer or his designated representative shall serve as ex officio chairman of the advisory committee. Advisory committee members may hold over and shall continue to serve until a replacement is named by the State Health Officer.
