Senate Bill 3124

AN ACT TO AUTHORIZE THE BOARD OF TRUSTEES OF THE CLAY COUNTY ECONOMIC DEVELOPMENT DISTRICT TO SELL CERTAIN REAL PROPERTY; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) The Trustees of the Clay County Economic Development District are authorized and empowered to sell certain real property to individuals, firms or corporations, public or private, upon such terms and conditions, and for such considerations, with such safeguards as will best promote and protect the public interest, convenience and necessity, and to execute deeds, leases, contracts, easements and other legal instruments necessary or convenient therefor, to wit:

Commencing at a found PK Nail at the SE corner of the NE 1/4 of Section 6, T-17-S, R-7-E, Clay County, Mississippi; thence East, a distance of 2,277.66 feet; thence North, a distance of 2,740.96 feet to the point of beginning; from said point of beginning thence N15°63'31"W, a distance of 63.33 feet; thence N08°02'01"W, a distance of 169.64 feet; thence N08°48'52"W, a distance of 71.89 feet; thence N00°24'01"W, a distance of 381.44 feet; thence N19°31'42"W, a distance of 481.14 feet; thence N20°03'56"W, a distance of 589.05 feet; thence N20°03'04"W, a distance of 701.70 feet; thence N19°20'44"W, a distance of 199.99 feet; thence N85°42'23"W, a distance of 22.12 feet; thence N88°17'13"W, a distance of 183.81 feet; thence N87°52'12"W, a distance of 114.24 feet; thence N88°32'42"W, a distance of 91.06 feet; thence N88°33'19"W, a distance of 514.47 feet; thence N00°01'42"E, a distance of 2,548.23 feet; thence West, a distance of 599.94 feet; thence N00°00'44"E, a distance of 225.18 feet; thence S89°57'18"E, a distance of 1,764.05 feet; thence S89°57'18"E, a distance of 859.48 feet; thence South, a distance of 2,779.90 feet; thence South, a distance of 2,555.86 feet; thence N89°44'13"W, a distance of 375.12 feet to the point of beginning located in the NW 1/4 of the NW 1/4, SW 1/4 of the NW 1/4, SE 1/4 of the NW 1/4, NE 1/4 of the NW 1/4, NE 1/4 of the SW 1/4, and the SE 1/4 of the SW 1/4 of Section 32, T-16-S, R-7-E, Clay County, Mississippi and containing 171.9292 acres, more or less.

(2) A portion of the funds from the sale of the above-described real property shall be used by the Clay County Economic Development District to repair railroad track beds crossing district property.

SECTION 2. This act shall take effect and be in force from and after its passage.
