House Concurrent Resolution 34

A CONCURRENT RESOLUTION PROPOSING AN AMENDMENT TO THE MISSISSIPPI CONSTITUTION OF 1890, TO PROVIDE EQUAL PROTECTION FOR THE RIGHT TO LIFE OF EACH BORN AND UNBORN HUMAN PERSON.

     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI, That the following amendment to the Mississippi Constitution of 1890 is proposed to the qualified electors of the state:

     Amend the Mississippi Constitution of 1890 by creating a new section to read as follows:

     "Section    .  To provide equal protection for the right to life of each born and unborn human person, the right to life is vested in each human being.  Nothing in this section shall be construed to require the prosecution of any woman for the death of her unborn child, a prohibition on in vitro fertilization, or a prohibition on the use of birth control or other contraception.

      As used in this section, the terms "human person" and "human being" mean each member of the species homo sapiens at all stages of life, including the moment of fertilization or cloning, or other moment at which an individual member of the human species comes into being."

     BE IT FURTHER RESOLVED, That this proposed amendment shall be submitted by the Secretary of State to the qualified electors at an election to be held on the first Tuesday after the first Monday of November 2019, as provided by Section 273 of the Constitution and by general law.

     BE IT FURTHER RESOLVED, That the explanation of this proposed amendment for the ballot shall read as follows:  "This proposed constitutional amendment provides equal protection for the right to life of each born and unborn human person, at all stages of life, including the moment of fertilization or cloning, or other moment at which an individual member of the human species comes into being."
