Senate Bill 3038

AN ACT TO AUTHORIZE THE BOARD OF COMMISSIONERS OF THE CHUQUANTONCHEE CONSOLIDATED DRAINAGE DISTRICT TO PAY CERTAIN DISTRICT FUNDS TO CHICKASAW AND CLAY COUNTIES; TO REQUIRE SUCH FUNDS TO BE USED BY THE COUNTIES FOR CERTAIN PURPOSES; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) The Board of Commissioners of the Chuquantonchee Consolidated Drainage District is authorized and empowered, in its discretion, to pay to Chickasaw and Clay Counties the amount in a reserve fund that has accumulated over approximately forty-five (45) years. The amount in the reserve fund is approximately Three Hundred Forty-five Thousand Dollars ($354,000.00). Based on the benefitted acres in each county, Chickasaw County shall be paid an amount equal to Seventy-seven and forty-eight one-hundredths percent (77.48%) of the amount in the reserve fund and Clay County shall be paid twenty-two and fifty-two one-hundredths percent (22.52%) of the amount in the reserve fund.

(2) The Boards of Supervisors of Chickasaw and Clay Counties are authorized to receive the funds described in subsection (1) of this section and shall utilize the funds solely for maintenance of the Chuquantonchee Drainage Channel, bridges that cross the channel and road approaches to the bridges that cross the channel.

SECTION 2. This act shall take effect and be in force from and after its passage.
