AN ACT TO AUTHORIZE THE COMMISSIONER OF INSURANCE TO ADOPT RULES AND REGULATIONS THAT PERTAIN TO THE COVERAGE OF PRESCRIPTION DRUGS THROUGH A DRUG FORMULARY; TO PROVIDE A DEFINITION OF A DRUG FORMULARY; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The Commissioner of Insurance may adopt rules and regulations that pertain to the coverage of prescription drugs through a drug formulary; specifically, that address the filing of a drug formulary with the commissioner; the continuation of drug coverage; and notice to enrollees of modifications of drugs on the drug formularies covered under any group or individual health benefit plan offered in this state by an insurance company, health maintenance organization, prepaid hospital or medical care plan, a multiple employer welfare arrangement, or any other person providing a plan of insurance subject to state insurance regulation.
(2) For the purposes of this chapter, a drug formulary is a list of prescription drugs which meet any of the following criteria:
(a) For which a health benefit plan provides coverage;
(b) For which a health benefit plan approves payment; or
(c) For which a health benefit plan encourages or offers incentives for physicians or other authorized prescribers to prescribe.
SECTION 2. Section 1 of this act shall be codified as a new section in Chapter 9, Title 83, Mississippi Code of 1972.
SECTION 3. This act shall take effect and be in force from and after July 1, 2018.
