AN ACT TO AMEND SECTION 49-7-41, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT FOR HUNTERS 75 YEARS OF AGE OR OLDER ALL OF THE BAG LIMIT ON ANTLERED DEER SET BY THE COMMISSION ON WILDLIFE, FISHERIES AND PARKS MAY BE ANY ANTLERED DEER; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 49-7-41, Mississippi Code of 1972, is amended as follows:

     49-7-41.  (1)  The commission may set the bag limits for game animals, birds and fish, unless the bag limits are established by the Legislature by statute.

     (2)  The commission shall have plenary authority to set the bag limits for white-tailed deer, and promulgate any regulations necessary to facilitate the exercise of that authority, consistent with best management practices, scientific data and subject to all existing applicable laws, rules and regulations of this state or the United States of America.

     (3)  The bag limit on antlerless deer set by the commission as authorized in this section shall not apply to private lands under the Deer Management Assistance Program or the Fee-based Antlerless Program as approved by the department.

     (4)  For hunters seventy-five (75) years of age or older, all of the bag limit on antlered deer set by the commission as authorized in this section may be any antlered deer.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2018.
