AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION, ACTING ON BEHALF OF THE BOARD OF TRUSTEES OF STATE INSTITUTIONS OF HIGHER LEARNING, TO TRANSFER CERTAIN REAL PROPERTY UNDER THE POSSESSION AND CONTROL OF DELTA STATE UNIVERSITY, AND LOCATED IN THE CITY OF CLARKSDALE, COAHOMA COUNTY, MISSISSIPPI, TO COAHOMA COMMUNITY COLLEGE; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The Department of Finance and Administration, in consultation with the Board of Trustees of State Institutions of Higher Learning, is authorized to transfer certain real property and any improvements thereon, known as the "Cutrer Mansion," which is under the possession and control of Delta State University, and located in the City of Clarksdale, Coahoma County, Mississippi, to Coahoma Community College. The real property is more particularly described as follows:
A parcel of land which is situate in Section Fourteen (14), Township Twenty-Seven (27) North, Range Four (4) West, Coahoma County, Mississippi, described by metes and bounds as follows, to wit:
Beginning at a point where the center line of John Street, in Clarksdale, Mississippi, intersects the north line of Clark Street in Clarksdale, Mississippi, thence South seventy-five (75) degrees, thirty-eight (38) minutes West, three hundred ninety-six and 25/100 (396.25) feet along the north line of Clark Street to a point, which point is the point of beginning; thence North fourteen (14) degrees, twenty-two (22) minutes West two hundred two (202) feet to a point; thence North two (2) degrees forty-six (46) minutes East four hundred forty-seven and two-tenths (447.2) feet to a stake in the center of Mill Bayou; thence in a westerly direction along the center line of Mill Bayou to its intersection with the East line of the Clarksdale-Friars Point public road; these South twenty-nine (29) minutes West along said East line of said public road to the intersection with the North line of Clark Street extended in a westerly direction; thence in an easterly direction along the North line of Clark Street extended in a westerly direction and along the North line of Clark Street to the point of beginning.
There is excepted from the warranty of this instrument, and this conveyance is made subject to the following:
1. The lien of the 2004 ad valorem taxes and special assessments, which taxes and assessments the Grantee herein assumes and agrees to pay when and as due;
2. All rights of way and easements, if any, for public roads, public utilities and drainage over, through and across said property; and
3. All recorded protective covenants and restrictions, if any, regarding said property and the subdivision in which said property is located.
(2) The Department of Finance and Administration may correct any discrepancies in the legal description of the property provided in this section.
(3) The State of Mississippi shall retain all mineral rights to the real property conveyed and transferred under this section.
SECTION 2. This act shall take effect and be in force from and after its passage.
