AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION, ACTING ON BEHALF OF THE BOARD OF TRUSTEES OF STATE INSTITUTIONS OF HIGHER LEARNING, TO CONVEY CERTAIN STATE-OWNED REAL PROPERTY LOCATED IN COAHOMA COUNTY, MISSISSIPPI, TO THE BOARD OF TRUSTEES OF COAHOMA COMMUNITY COLLEGE; TO REQUIRE THE BOARD OF TRUSTEES OF COAHOMA COMMUNITY COLLEGE TO CARRY OUT CERTAIN FUNCTIONS RELATIVE TO THE MANAGEMENT AND OPERATION OF THE COAHOMA COUNTY HIGHER EDUCATION CENTER; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Department of Finance and Administration, acting on behalf of the Board of Trustees of State Institutions of Higher Learning, is authorized to donate, transfer and convey for no consideration to the Board of Trustees of Coahoma Community College, for the use and benefit of the Coahoma County Higher Education Center, the following real property in Coahoma County, Mississippi, known as the Cutrer Mansion lot, St. Elizabeth School lot, and St. Elizabeth Gymnasium lot:

A parcel of land which is situate in Section Fourteen (14), Township Twenty-Seven (27) North, Range Four (4) West, Coahoma County, Mississippi, described by metes and bounds as follows, to wit:

     Beginning at a point where the center line of John Street, in Clarksdale, Mississippi, intersects the north line of Clark Street in Clarksdale, Mississippi, thence South seventy-five (75) degrees, thirty-eight (38) minutes West three hundred ninety-six and 25/100 (396.25) feet along the north line of Clark Street to a point, which point is the point of beginning; thence North fourteen (14) degrees, twenty-two (22) minutes West two hundred two (202) feet to a point; thence North two (2) degrees forty-six (46) minutes East four hundred forty-seven and two-tenths (447.2) feet to a stake in the center of Mill Bayou; thence in a westerly direction along the center line of Mill Bayou to its intersection with the East line of the Clarksdale-Friars Point public road; thence South twenty-nine (29) minutes West along said East line of said public road to the intersection with the North line of Clark Street extended in a westerly direction; thence in an easterly direction along the North line of Clark Street extended in a westerly direction along the North line of Clark Street to the point of beginning.

     Together with all improvements situated thereon and all appurtenances thereunto belonging, LESS AND EXCEPT all easements and rights-of-way record.

     (2)  The Board of Trustees of Coahoma Community College shall be responsible for the management and upkeep of the above-described property, as well as any facilities thereon and any improvements that may at some future date be constructed on the site.

     (3)  The Board of Trustees of Coahoma Community College shall ensure that the Coahoma County Higher Education Center carries out the purposes of providing higher education, workforce training, and/or other continuing education opportunities to the public at the above-described property.  The Department of Finance and Administration and the institutions of higher learning are authorized to convey the above described property on the condition that it shall be used for such purposes and further provided that the property shall revert to the state in the event that the Board of Trustees of Coahoma Community College should operate the center contrary to such purposes, abandons such property or attempts to sell or transfer all or a portion of such property to another entity.

     (4)  The Department of Finance and Administration is authorized to correct any discrepancies in the legal description of the property provided in subsection (1) of this section.

     (5)  The State of Mississippi shall retain all mineral rights to the real property conveyed and transferred under this section.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
