House Bill 1353

AN ACT TO PROHIBIT THE WEARING OF PANTS, SHORTS OR CLOTHING BOTTOMS THAT EXPOSE UNDERWEAR OR BODY PARTS IN AN INDECENT OR VULGAR MANNER; TO PROVIDE PENALTIES FOR VIOLATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  It shall be unlawful for any person to wear pants, shorts or clothing bottoms that exposes underwear or body parts in an indecent or vulgar manner.  Any person who violates the provisions of this section shall, upon conviction, be warned or punished as follows:

          (a)  For a first or second offense by a verbal warning and if the offender is a minor the parents or guardians shall be notified;

          (b)  For a third offense by a fine of Twenty Dollars ($20.00);

          (c)  For a fourth offense by a fine of Thirty Dollars ($30.00);

          (d)  For a fifth offense by a fine of Forty Dollars ($40.00); and

          (e)  For a sixth or subsequent offense by a fine of One Hundred Dollars ($100.00) and psychological and social counseling by the Department of Human Services and the Department of Mental Health.

     (2)  Violations of subsection (1) shall be noncriminal citations.  The provisions of this section may be used in addition to any other penalty provided by law for exposing underwear or body parts.  The provisions of this section shall not be construed to limit or restrict any other criminal penalties for exposure of underwear or body parts.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2017.
