AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION, ACTING ON BEHALF OF THE DEPARTMENT OF REVENUE, TO ACQUIRE CERTAIN REAL PROPERTY IN CLINTON, HINDS COUNTY, MISSISSIPPI, FOR THE USE AND BENEFIT OF THE DEPARTMENT OF REVENUE; TO ALLOW THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO CORRECT ANY DISCREPANCIES IN THE LEGAL DESCRIPTION TO THE PROPERTY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Mississippi Department of Finance and Administration, acting on behalf of the Department of Revenue, is authorized to acquire certain real property and the improvements thereon in the method as determined in the best interest of the State of Mississippi, located in the corporate limits of the City of Clinton, Hinds County, Mississippi, for the use and benefit of the Department of Revenue, which such property is more particularly described as follows:

Property known as the "South Pointe Business Park," located on a parcel of land situated in the Southeast Quarter and the Southwest Quarter of Section 30, Northeast Quarter of the Northwest Quarter of Section 31, Township 6 North, Range 1 West, City of Clinton, Hinds County, Mississippi, and being more particularly described as follows:

A parcel of land situated in the Southeast Quarter and the Southwest Quarter of Section 30, and the Northeast Quarter of the Northwest Quarter of Section 31, Township 6 North, Range 1 West, City of Clinton, Hinds County, Mississippi, and being more particularly described as follows:

Begin at a 1" rebar found marking the Southeast corner of Section 30, Township 6 North, Range 1 West, said Hinds County; thence S 89º45'37" W a distance of 1333.97 feet to a 2" open top pipe found; thence N 89º57'21" W a distance of 270.56 feet to a 5/8" capped rebar set (SMW LS 02859); thence S 89º07'15" W a distance of 1053.44 feet to a 5/8" capped rebar set (SMW IS 02859) marking the Southwest corner of the Southeast Quarter of said Section 30; thence S 01º53'30" W a distance of 168.00 feet to a 2" open top pipe found; thence S 89º34'54" W a distance of 579.24 feet to a 5/8" capped rebar set (SMW LS 02859) on the easterly right—of—way line of Clinton—Raymond Road; thence northeasterly along said easterly right-of-way line the following courses and distances: 

N 40º56'36" E a distance of 126.58 feet to a 5/8" capped rebar set (SMW LS 02859); N 26º49'O6" E a distance of 261.21 feet to a 5/8" capped rebar set (SMW LS 02859); N 25º49'09" E a distance of 385.13 feet to a 5/8" rebar found; thence leaving said easterly right—of—way line S 72º52'2" E a distance of 11.68 feet to a 5/8" capped rebar set (SMW LS 02859); thence along the easterly and southerly line of a parcel of land as conveyed to the Mississippi Transportation Commission and recorded in Deed Book 4986, Page 413 on the Chancery Clerks Office of said Hinds County the following courses and distances: 

N 28º12'5l" E a distance of 252.49 feet to a concrete monument found; N 39º38'00" E a distance of 164.79 feet to a 5/8" capped rebar set (SMW LS 02859); along a curve turning to the left with an arc length of 205.80 feet, with a radius of 2994.79 feet, with a chord bearing of N 16º51'07" E and a chord length of 205.76 feet to a concrete monument found; N 09º41' 42" W a distance of 124.90 feet to a 5/8" capped rebar set (SMW LS 02859); N 12º41'32" E a distance of 442.47 to a 5/8" capped rebar set (SMW LS 02859); N 34º29'37" E a distance of 161.55 feet to a 5/8" capped rebar set (SMW LS 02859); S 79º46'47" E a distance of 416.86 feet to a 5/8" capped rebar set (SMW LS 02859); S 67º35'50" E a distance of 677.20 feet to a 5/8" rebar found marking the most eastern corner of said parcel conveyed to the Mississippi Transportation Commission; thence leaving said southerly line and along the southwesterly right—of—way line of Interstate 20 the following courses and distances:

S 51º14'16" E a distance of 110.19 feet to a 5/8" capped rebar set (SMW LS 02859); along a curve turning to the left with an arc length of 544.47 feet, with a radius of 17359.72 feet, with a chord bearing of S 52º21'53" E and a chord length of 544.44 feet to a 5/8" rebar found; S 50º51'40" E a distance of 303.42 feet to a 5/8" rebar found; along a curve turning to the left with an arc length of 755.37 feet, with a radius of 17374.72 feet, with a chord bearing of S 55º15'57" E and a chord length of 755.31 feet to a 5/8" capped rebar set (SMW LS 02859); thence leaving said southwesterly right-of-way line S 00º15'56" E a distance of 357.17 feet to the Point of Beginning. Said described parcel of land contains 79.12 acres, more or less.

     (2)  The real property and the improvements thereon, described in subsection (1) of this section, shall be acquired for the purposes specified in that subsection for not more than the current fair market value as determined by the average of at least two (2) appraisals by qualified appraisers, who shall be selected by the Department of Finance and Administration and shall be certified and licensed by the Mississippi Real Estate Appraiser Licensing and Certification Board.

     (3)  The Department of Finance and Administration may correct any discrepancies in the legal description provided in subsection (1) of this section.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
