AN ACT TO AUTHORIZE THE EXCHANGE OF CERTAIN REAL PROPERTY BETWEEN THE BOARD OF SUPERVISORS OF SIMPSON COUNTY, ACTING ON BEHALF OF THE SIMPSON COUNTY ECONOMIC DEVELOPMENT DISTRICT, AND THE DEPARTMENT OF FINANCE AND ADMINISTRATION, ACTING ON BEHALF OF THE MISSISSIPPI DEPARTMENT OF MENTAL HEALTH, FOR PURPOSES OF ACCOMMODATING THE EXPANSION OF THE MAGEE MUNICIPAL AIRPORT; TO AUTHORIZE THE BOARD OF SUPERVISORS OF SIMPSON COUNTY TO EXCHANGE CERTAIN REAL PROPERTY WITH A CERTAIN PRIVATE LANDOWNER, SUBJECT TO CERTAIN CONDITIONS HAVING BEEN MET BEFORE THE TRANSFER; TO AUTHORIZE THE BOARD OF SUPERVISORS OF SIMPSON COUNTY TO SELL AND CONVEY THE REAL PROPERTY RECEIVED FROM THE EXCHANGE WITH THE PRIVATE LANDOWNER TO THE CITY OF MAGEE, SUBJECT TO CERTAIN CONDITIONS HAVING BEEN MET BEFORE THE SALE AND CONVEYANCE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Board of Supervisors of Simpson County, acting on behalf of the Simpson County Economic Development District, and the Department of Finance and Administration, acting on behalf of Simpson County and the Mississippi Department of Mental Health, are authorized to exchange certain real property between those two (2) entities for purposes of accommodating the expansion of the Magee Municipal Airport, subject to the requirements of Section 19-7-3.

     (2)  Under the authority granted by subsection (1) of this section, the Board of Supervisors of Simpson County shall transfer all the rights, title and interest in a certain parcel of real property totaling forty (40) acres, which is owned by Simpson County for the use and benefit of the Simpson County Economic Development District, and which is adjacent to the Magee Municipal Airport, to the Mississippi Department of Mental Health, for the use and benefit of the Boswell Regional Center, in exchange for forty (40) acres of like real property of approximate equal current fair market value as determined by the average of at least two (2) appraisals by qualified appraisers and all the rights, title and interest pertaining thereto, to be transferred by the Department of Finance and Administration, acting on behalf of the Mississippi Department of Mental Health.  The parcel of real property to be transferred by the Department of Finance and Administration in exchange for the real property owned by Simpson County shall be apportioned from two hundred six (206) acres more or less under the direction and control of the Mississippi Department of Mental Health, which is adjacent to the forty (40) acres owned by Simpson County.

     The property under the direction and control of the Mississippi Department of Mental Health, from which the forty (40) acres is to be apportioned, is more particularly described as follows:

A parcel of land being the SW 1/4 of the SE 1/4, the SE 1/4 of the NE 1/4, a part of the SE 1/4 of the SW 1/4, a part of the NE 1/4 of the SE 1/4, a part of the NW 1/4 of the SE 1/4, a part of the SE 1/4 of the NE 1/4, a part of the NE 1/4 of the NE 1/4, a part of the NW 1/4 of the NE 1/4, all in Section 3, Township 10 North, Range 18 West, Simpson County, Mississippi, and being more particularly described as follows:

Commence at an axle beside a fence corner marking the SE Corner of the SE 1/4 of the SE 1/4 of said Section 3; thence North 89 degrees 54 minutes 10 seconds West along the south line of the said Section 3 for 1334.99 feet to an iron pin set beside a fence corner, said point also being the Point of Beginning; thence North 89 degrees 50 minutes 01 seconds West along said south line for 2139.58 feet to a metal pipe found beside a fence corner; thence North 00 degrees 04 minutes 48 seconds West for 1529.69 feet to a metal pipe found beside a fence corner on the North line of the said SE 1/4 of the SW 1/4; thence South 89 degrees 58 minutes 43 seconds East along said north line and the north line of the said SW 1/4 of the SE 1/4 for 1145.22 feet to a metal pipe found beside a fence corner; thence North 00 degrees 15 minutes 01 seconds East for 1519.36 feet to an iron pin set beside a fence corner on the south line of the said SW 1/4 of the NE 1/4; thence North 89 degrees 57 minutes 40 seconds West along said south line for 295.79 feet to an iron pin set beside a fence corner marking the SW Corner of the said SW 1/4 of the NE 1/4; thence North 00 degrees 25 minutes 12 seconds East along the west line of the said SW 1/4 of the NE 1/4 for 1534.04 feet to an iron pin set beside a fence corner marking the NW Corner of the said SW 1/4 of the NE 1/4; thence South 89 degrees 29 minutes 30 seconds East along the north line of the said SW 1/4 of the NE 1/4 for 723.41 feet to an iron pin set beside a fence corner; thence North 00 degrees 06 minutes 17 seconds West for 587.37 feet to an iron pin set beside a fence corner; thence North 89 degrees 56 minutes 06 seconds East for 645.86 feet to an iron pin set in the centerline of State Farm Road; thence South 25 degrees 53 minutes 48 seconds East along said centerline for 265.70 feet to an iron pin set; thence along said centerline along a curve to the left for 47.43 feet to an iron pin set, said curve having a radius of 286.88 feet, an included angle of 09 degrees 28 minutes 21 seconds, a chord of South 44 degrees 02 minutes 34 seconds East for 47.37 feet; thence South 50 degrees 11 minutes 47 seconds East along said centerline for 78.17 feet to an iron pin set; thence along said centerline along a curve to the right for 81.37 feet to an iron pin set, said curve having a radius of 204.89 feet, an included angle of 22 degrees 45 minutes 12 seconds, a chord of South 38 degrees 18 minutes 15 seconds East for 80.83 feet; thence South 28 degrees 37 minutes 51 seconds East along said centerline for 126.31 feet to an iron pin set; thence along said centerline along a curve to the right for 73. 16 feet to an iron pin set, said curve having a radius of 288.95 feet, an included angle of 14 degrees 30 minutes 22 seconds, a chord of South 18 degrees 25 minutes 05 seconds East for 72.96 feet; thence South 08 degrees 05 minutes 39 seconds East along said centerline for 199.27 feet to an iron pin set; thence along said centerline along a curve to the left for 184.74 feet to an iron pin set, said curve having a radius of 287.22 feet, an included angle of 36 degrees 51 minutes 13 seconds, a chord of South 20 degrees 42 minutes 36 seconds East for 181.57 feet; thence south 49 degrees 13 minutes 04 seconds East along said centerline for 84.28 feet to an iron pin set; thence along said centerline along a curve to the right for 235.70 feet to an iron pin set, said curve having a radius of 349.00 feet, an included angle of 38 degrees 41 minutes 45 seconds, a chord of South 33 degrees 25 minutes 51 seconds East for 231.25 feet; thence South 12 degrees 18 minutes 43 seconds East along said centerline for 197.66 feet to an iron pin set; thence along said centerline along a curve to the left for 134.81 feet to an iron pin set, said curve having a radius of 104.62 feet, an included angle of 73 degrees 49 minutes 39 seconds, a chord of South 46 degrees 03 minutes 45 seconds East for 125.68 feet; thence South 77 degrees 34 minutes 19 seconds East along said centerline for 516.81 feet to an iron pin set on the east line of the said SE 1/4 of the NE 1/4; thence South 00 degrees 06 minutes 07 seconds West along said east line for 533.58 feet to an iron pin set beside a fence corner marking the SE Corner of the said SE 1/4 of the NE 1/4; thence North 89 degrees 32 minutes 14 seconds West along the south line of the said SE 1/4 of the NE 1/4 for 673.39 feet to an iron pin set beside a fence corner; thence South 00 degrees 17 minutes 20 seconds West for 512.83 feet to an iron pin set beside a fence corner; thence North 89 degrees 31 minutes 50 seconds West for 658.41 feet to an iron pin set beside a fence corner; thence South 00 degrees 29 minutes 34 seconds West for 2561.87 feet back to the Point of Beginning.  Said parcel contains 206.22 acres more or less.

     (3)  Subject to the exchange authorized in subsection (1) of this section of the properties described in subsection (2) of this section, the Board of Supervisors of Simpson County, acting on behalf of the Simpson County Economic Development District, is authorized to transfer thirty (30) acres of the newly acquired forty (40) acres received in the exchange with the Mississippi Department of Mental Health, and all the rights, title and interest pertaining thereto, in exchange for fifteen (15) acres of land and all the rights, title and interest pertaining thereto, owned by a certain private landowner to be transferred to the county, which is adjacent to the Magee Municipal Airport landing strip, subject to the requirements of Section 19-7-3.  The privately held fifteen (15) acres shall be of approximate equal current fair market value of the state-held thirty (30) acres, as determined by the average of at least two (2) appraisals by qualified appraisers who shall be selected by the board of supervisors.

     (4)  Subject to the exchange authorized in subsection (3) of this section, the Board of Supervisors of Simpson County, acting on behalf of the Simpson County Economic Development District, is authorized to sell and convey the newly acquired fifteen (15) acres and all the rights, title and interest pertaining thereto received in the exchange with the private landowner, to the City of Magee, subject to the requirements of Section 19-7-3.  The sale of the real property under this subsection shall be for an amount not less than the current fair market value as determined by the average of at least two (2) appraisals by qualified appraisers, who shall be selected by the board of supervisors and shall be certified and licensed by the Mississippi Real Estate Appraisers Licensing and Certification Board.

     (5)  The State of Mississippi shall retain all mineral rights to the properties exchanged or sold under the provisions of this section.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
