AN ACT TO CREATE SECTION 97-9-116, MISSISSIPPI CODE OF 1972, TO INCLUDE BRIBING A JUDGE IN OFFENSES AFFECTING JUSTICE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The following shall be codified as Section 97-9-116, Mississippi Code of 1972:

     97-9-116.  (1)  A person commits the crime of bribing a judge if he intentionally or knowingly offers, confers or agrees to confer any benefit upon a judge with the intent that the judge's decision, vote, recommendation or other exercise of official discretion in a judicial or administrative proceeding will thereby be influenced.

     (2)  Bribing a judge is a felony punishable by imprisonment for not less than five (5) years nor more than twenty (20) years and by a fine three (3) times the amount of the bribe but in no case less than Twenty-five Thousand Dollars ($25,000.00).

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2008.
