SUBSTITUTE NO 1 FOR AMENDMENT NO 2 TO AMENDMENT NO 1 PROPOSED TO

Senate Bill No. 2764

     AMEND by striking Section 5 and substituting the following in lieu thereof:

     SECTION 5.  The following shall be codified as Section 41-3-5.1, Mississippi Code of 1972:

     41-3-5.1.  The board shall proceed to elect an executive officer who shall be a physician having earned a graduate degree in public health or health care administration or, in the alternative, be a physician who in the opinion of the board is fitted and equipped to execute the duties incumbent upon him by law.  The executive officer shall not engage in the private practice of medicine.  His term of office shall be six (6) years. The executive officer shall be subject to such rules and regulations as may be prescribed by the State Board of Health.  The executive officer shall be the State Health Officer with such authority and responsibility as is prescribed by law.  The executive officer may be removed for cause by majority vote of the members of the board.

     FURTHER, amend the title amendment to conform.
