AMENDMENT NO 3 TO SUBSTITUTE NO 1 FOR COMMITTEE AMENDMENT NO 1 PROPOSED TO

House Bill No. 1202

     AMEND by inserting the following after line 754 and renumbering:

          (*)  The State Department of Health may issue one or more certificates of need to any continuing care retirement community (CCRC) which was licensed and operating as of January 11, 2007, for the conversion of non-Medicaid participating nursing facility beds to Medicaid-certified nursing facility beds, provided that (i) the conversion of these beds shall be accomplished through the relocation to the CCRC of nursing facility beds which were licensed and Medicaid-certified in another nursing facility in the state, as of January 1, 2007, and (ii) the total number of Medicaid-certified beds in any CCRC shall not exceed forty (40).  For purposes of this subsection and any certificates of need issued hereunder, the Medicaid-certified nursing facility beds may be relocated to the CCRC from any licensed nursing facility in the state, notwithstanding the Long-Term Care Planning Districts or other provisions in the State Health Plan.  Additionally, for purposes of this subsection, the provisions of Section 41-1-193(1) requiring substantial compliance with the projection of need as reported in the current State Health Plan are waived.

     FURTHER, AMEND the title amendment by inserting the following after the semicolon on line 28:

TO AUTHORIZE THE ISSUANCE OF A CERTIFICATE OF NEED FOR THE CONVERSION OF NON-MEDICAID BEDS AT A CONTINUING CARE RETIREMENT FACILITY;
