AMENDMENT NO 1 TO SUBSTITUTE NO 1 FOR COMMITTEE AMENDMENT NO 1 PROPOSED TO

House Bill No. 1202

     AMEND by inserting the following paragraph after line 754 and renumber:

          (v)  (i)  The State Department of Health shall issue certificates of need for long-term care beds in each of the four (4) Long-Term Care Planning Districts designated in the fiscal year 2006 State Health Plan, to provide care exclusively to patients with Alzheimer's disease.  In issuing the certificates of need under this paragraph (v), the department shall give preference to existing facilities that could accommodate Alzheimer's patients without the construction of new facilities and to providers that have shown positive performance in providing long-term care to patients with Alzheimer's disease or dementia.

              (ii)  Not more than twenty (20) beds may be authorized by any certificate of need issued under this paragraph (v), and not more than a total of forty (40) beds may be authorized in any Long-Term Care Planning District by all certificates of need issued under this paragraph (v).

              (iii)  The State Department of Health, in consultation with the Department of Mental Health and the Division of Medicaid, shall develop and prescribe the staffing levels, space requirements and other standards and requirements that must be met with regard to the beds authorized under this paragraph (v) to provide care exclusively to patients with Alzheimer's disease.

     FURTHER, AMEND the title amendment by inserting the following after the semicolon on line 28:

TO DIRECT THE STATE DEPARTMENT OF HEALTH TO ISSUE CERTIFICATES OF NEED IN EACH OF THE FOUR LONG-TERM CARE PLANNING DISTRICTS TO PROVIDE ALZHEIMER'S DISEASE CARE;
