House Amendments to Senate Bill No. 2760

 

TO THE SECRETARY OF THE SENATE:

 

  THIS IS TO INFORM YOU THAT THE HOUSE HAS ADOPTED THE AMENDMENTS SET OUT BELOW:

 

 

 

AMENDMENT NO. 1

 


     AMEND on line 25 by inserting the following language after the word "with":  "or without"

     AMEND FURTHER on line 56 by deleting the language beginning with the word "at" through the word "session" on line 57.

     AMEND FURTHER by deleting Section 6 in its entirety and by inserting the following language in lieu thereof:

     "SECTION 6.  This act shall not apply to a municipality if the municipality employs five (5) or less full-time law enforcement sworn officers."

     AMEND FURTHER by adding the following language after line 62 and by renumbering the succeeding section:

     "SECTION 8.  This act shall not apply to any municipality that has a civil service commission, or has an ordinance or written procedures regarding due process rights."

     AMEND FURTHER the title by striking it in its entirety and inserting the following in lieu thereof:

     "AN ACT TO REQUIRE MUNICIPALITIES TO PROVIDE A PRE-DISCIPLINARY HEARING PRIOR TO THE SUSPENSION OR TERMINATION OF ANY LAW ENFORCEMENT OFFICER; TO ESTABLISH A MINIMUM LEVEL OF WRITTEN DUE PROCESS PROCEDURES; TO SPECIFY WHAT NOTICE SHALL BE PROVIDED TO THE OFFICER; TO PROVIDE THAT THE OFFICER MAY ATTEND THE HEARING, MAY BE REPRESENTED BY COUNSEL, MAY PRESENT EVIDENCE ON HIS OR HER OWN BEHALF, AND MAY QUESTION WITNESSES AGAINST HIM OR HER; TO PROVIDE THAT FINAL ADJUDICATION SHALL BE HELD IN OPEN MEETING; TO EXEMPT MUNICIPALITIES THAT HAVE A CIVIL SERVICE COMMISSION OR THAT EMPLOY LESS THAN FIVE FULL-TIME LAW ENFORCEMENT OFFICERS FROM THIS ACT; AND FOR RELATED PURPOSES."
