AN ACT TO PLACE CERTAIN RESTRICTIONS ON THE USE OF ALL-TERRAIN VEHICLES; TO PROVIDE A PENALTY FOR VIOLATING SUCH RESTRICTIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  No person shall operate an all-terrain vehicle on any public highway, street or road.

     (2)  No person shall operate or ride upon an all-terrain vehicle without wearing a crash helmet of the type and design inspected and approved by the American Association of Motor Vehicle Administrators.

     (3)  No more that one (1) person shall operate or ride upon an all-terrain vehicle designed for one (1) person.

     (4)  This section shall not apply to any law enforcement officer, emergency personnel or fireman in the course of his official duties.

     (5)  Any person convicted of a violation of this section shall be punished by a fine of not more than One Hundred Dollars ($100.00); for a second conviction within one (1) year of the first conviction, the person shall be punished by a fine of not more than Two Hundred Dollars ($200.00); for a third or subsequent conviction, a person shall be punished by a fine of not more than Five Hundred Dollars ($500.00) or imprisonment for not more than five (5) days, or both.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2007.
