AN ACT TO AUTHORIZE THE DEPARTMENT OF ARCHIVES AND HISTORY TO CONVEY CERTAIN REAL PROPERTY TO CERTAIN INDIVIDUALS IN EXCHANGE FOR SUCH INDIVIDUALS CONVEYING OWNERSHIP OF CERTAIN REAL PROPERTY THAT IS ADJACENT TO THE EUDORA WELTY HOUSE IN THE CITY OF JACKSON, HINDS COUNTY, MISSISSIPPI; TO AUTHORIZE THE DEPARTMENT OF ARCHIVES AND HISTORY TO ENTER INTO AN AGREEMENT WITH CERTAIN INDIVIDUALS FOR PURPOSE OF ALLOWING THE CONTINUED USE OF A CERTAIN PARCEL OF THE PROPERTY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  (a)  In consideration for the purchase of property described in subsection (2) of this section, the Mississippi Department of Archives may sell and convey to the Armstrongs, as partial payment, all right, title and interest in certain real property located in Jackson, Hinds County, Mississippi, such property described more particularly as follows:

The North Sixty feet of Lot six (6) and the North Sixty feet of the West Eight feet of Lot seven (7) all in Block Number Seven (7) of Magruders Second Subdivision of Block "P" of North Park Addition, according to the map or plat of said subdivision which is of record in the office of the Chancery Clerk of Hinds County at Jackson, Mississippi.  The State shall also convey its interest in the Alley lying immediately North of said Lot Six and North of the West eight feet of said Lot Seven to the Grantee(s), less and except the existing utility lines in said alley shall remain and shall be allowed to be extended and/or improved for the use and benefit of the Eudora Welty Property lying East of said Lots six and seven.

          (b)  The conveyance authorized in this subsection (1) may be subject to additional terms and conditions agreed upon by the Department of Archives and History and the Armstrongs.

     (2)  (a)  In consideration for the conveyance of property authorized in paragraph (1) of this section, as partial payment, the Armstrongs shall convey to the Department of Archives and History all right, title and interest in certain real property located in Jackson, Hinds County, Mississippi, such property described more particularly as follows:

Sixty Two feet off of the East side of Lot Number four (4) in Block Number Seven (7) of Magruders Second Subdivision of Block "P" of North Park Addition, according to the map or plat of said subdivision which is of record in the office of the Chancery Clerk of Hinds County at Jackson, Mississippi, in Surveyor's Record Book "B" at Page 69 thereof, reference to which is hereby made, and being the same property conveyed to Mrs. Cora Little Owen by T.D. Davis and wife, Mrs. Lillian M. Davis, on March 24, 1934, by instrument recorded in Deed Book 268, page 123 of the deed records on file in the office of the Chancery Clerk of said county.  The above described property is to be conveyed together with all the interest which the Grantors have in the alley running along the South side of said Lot Number four which is immediately South of the above property hereby conveyed.

          (b)  The conveyance authorized in this subsection (2) may be subject to additional terms and conditions agreed upon by

the Armstrongs and the Department of Archives and History.

     (3)  The Department of Archives and History is authorized to enter into agreement with one, Mr. Gilbert, who owns the South fifty-five (55) feet of Lots Six and Seven in Block Number Seven (7) of Magruders Second Subdivision of Block "P" of North Park Addition, according to the map or plat of said subdivision which is of record in the office of the Chancery Clerk of Hinds County at Jackson, Mississippi.  The Gilberts as noted herein and the Department of Archives and History may enter into a memorandum of agreement that will allow the Gilberts to maintain their air conditioning unit and small porch across the south four feet of said Lot Six (6) as currently exists and the Department of Archives and History shall have the continued use of and be allowed to improve the drainage structure at the department's discretion in the real property located in Jackson, Hinds County, Mississippi, such property described more particularly as follows:

Commencing at the Northwest Corner of Lot Six (6) of said block and subdivision for a point of commencement: Thence run S 00 degrees 00 minutes 24 seconds West along the East right-of-way of Peachtree Street for a distance of 100.00 feet; thence run North 88 degrees 49 minutes 35 seconds East for 108.93 feet to and for a point of beginning; thence continue North 88 degrees 49 minutes 35 seconds East for 14.80 feet; thence run S 46 degrees 19 minutes 31 seconds West for 31.37 feet; thence run North 43 degrees 40 minutes 29 seconds West for 10.00 feet; thence run North 46 degrees 19 minutes 31 seconds East for 20.46 feet back to the point of beginning, said parcel containing 0.0059 acres more or less and being a part of Lot Seven (7) of Block Number Seven (7) of Magruders Second Subdivision of Block "P" of North Park Addition, according to the map or plat of said subdivision which is of record in the office of the Chancery Clerk of Hinds County at Jackson, Mississippi.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
