AN ACT TO AMEND SECTIONS 5-5-5, 5-5-7, 5-5-9 AND 5-5-11, MISSISSIPPI CODE OF 1972, TO RENAME THE MISSISSIPPI COMMISSION ON INTERSTATE COOPERATION AS THE MISSISSIPPI COMMISSION ON COOPERATION AND TO REVISE AND DEFINE THE POWERS AND RESPONSIBILITIES OF THE COMMISSION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 5-5-5, Mississippi Code of 1972, is amended as follows:

     5-5-5.  There is hereby established the Mississippi Commission on * * * Cooperation, which shall encourage and arrange conferences with officials of other states and of other self-governed units of government; carry forward the participation of this state as a member of the Council of State Governments, both regionally and nationally; and formulate proposals for cooperation and such other agreements that may arise between this state and other states or other self-governed units of government, with the exception of the United States of AmericaNo such agreement shall be valid unless first proposed by the commission and approved by the State Legislature.

     SECTION 2.  Section 5-5-7, Mississippi Code of 1972, is amended as follows:

     5-5-7.  The Mississippi Commission on * * * Cooperation shall be composed of eleven (11) members, namely;

     The five (5) members of the Committee on Interstate and Federal Cooperation of the Senate,

     The five (5) members of the Committee on Interstate Cooperation of the House of Representatives, and

     The Governor.

     SECTION 3.  Section 5-5-9, Mississippi Code of 1972, is amended as follows:

     5-5-9.  The Mississippi Commission on * * * Cooperation may provide such rules as it considers appropriate concerning the membership and the functioning of the committee.  Members of the commission shall be compensated by a per diem as is authorized by law for each day spent in actual discharge of their duties and shall be reimbursed for mileage and actual expenses incurred in the performance of their duties in accordance with the requirements of Section 25-3-41.

     SECTION 4.  Section 5-5-11, Mississippi Code of 1972, is amended as follows:

     5-5-11.  The Mississippi Commission on * * * Cooperationshall report to the Governor and to the Legislature within fifteen (15) days after the convening of each regular legislative session, and at such other times as it deems appropriate.  Its members shall serve without compensation.

     SECTION 5.  This act shall take effect and be in force from and after July 1, 2007.
