AN ACT TO AUTHORIZE THE STATE BOARD OF TRUSTEES FOR INSTITUTIONS OF HIGHER LEARNING TO TRANSFER AND CONVEY TO THE STATE VETERANS AFFAIRS BOARD CERTAIN REAL PROPERTY LOCATED IN NEWTON COUNTY, MISSISSIPPI, FOR USE AS A STATE VETERANS CEMETERY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The State Board of Trustees for Institutions of Higher Learning is authorized to transfer and convey to the State Veterans Affairs Board certain state-owned real property located at the Mississippi State University Coastal Plains Experiment Station in Newton County, Mississippi, such property more specifically described as follows:

     Commence at an iron pin marking the Northwest corner of the SW 1/4 of SW 1/4 of Section 21 - Township 6 North - Range 12 East, Newton County, Mississippi; Thence run North 88 degrees 54 minutes 49 seconds East along a fence a distance of 322.68 feet to a fence corner; Thence run North 00 degrees 10 minutes 04 seconds West along a fence a distance of 474.14 feet to the south right-of-way fence of U.S. Interstate 20; Thence run North 80 degrees 56 minutes 12 seconds East along said south right-of-way fence of U.S. Interstate 20 a distance of 1,867.20 feet to 1/2" round iron pin; Thence run South a distance of 995.05 feet to a 1/2" round iron pin; Thence run North 88 degrees 06 minutes 54 seconds West a distance of 690.10 feet to a 1/2" round iron pin; Thence run South 27 degrees 59 minutes 46 seconds West a distance of 1,342.0 feet to a 1/2" round iron pin; Thence run North 56 degrees 40 minutes 42 seconds West a distance of 385.15 feet to a 1/2" round iron pin; Thence run North 85 degrees 23 minutes 59 seconds West a distance of 397.78 feet to a 1/2" round iron pin; Thence run South 01 degrees 49 minutes 32 seconds West a distance of 157.61 feet to a 1/2" round iron pin at a fence post; Thence run North 57 degrees 18 minutes 09 seconds West a distance of 99.82 feet to a 1/2" round iron pin at a fence corner; Said point is the apparent southwest corner of Section 21 - Township 6 North - Range 12 East; Thence run South 89 degrees 32 minutes 41 seconds West a distance of 191.91 feet along a fence to a fence post; Thence run North 170.22 feet to a 1/2" round iron pin; Thence run North 89 degrees 57 minutes 35 seconds West a distance of 393.19 feet to the assumed east right-of-way line of Experiment Station Road; Said point being 20 feet perpendicular to the centerline of road; Thence run a chord bearing of North 05 degrees 01 minutes 50 seconds East a distance of 206.40 feet to a point on said east right-of-way of said road; Thence run North 27 degrees 16 minutes 44 seconds East a distance of 79.39 feet to a point on said east right-of-way of said road; Thence run a chord bearing of North 17 degrees 20 minutes 10 seconds East a distance of 174.05 feet to a point on said east right-of-way of said road; Thence run North 07 degrees 23 minutes 39 seconds East a distance of 92.65 feet to a point on said east right-of-way of said road; Thence run a chord bearing of North 20 degrees 30 minutes 17 seconds East a distance of 143.48 feet to a point on said east right-of-way line of said road; Thence run North 33 degrees 41 minutes 11 seconds East a distance of 74.42 feet to a 1/2" round iron pin at a fence corner and on said east right-of-way; Thence run North 88 degrees 16 minutes 37 seconds East a distance of 382.27 feet along said fence to a 1/2" round iron pin at a fence corner; Thence run North 00 degrees 19 minutes 17 seconds East a distance of 409.46 feet along said fence back to the Point of Beginning; Said parcel of land is part of the SW 1/4 of Section 21 and the SE 1/4 of SE 1/4 of Section 20 and the NW 1/4 of NW 1/4 of Section 28 all in Township 6 North - Range 12 East, Newton County, Mississippi, and contains 76.00 acres more or less.

     (2)  The real property described in subsection (1) shall be used by the State Board of Veterans Affairs as a state veterans cemetery. 

     (3)  If construction of a state veterans cemetery on the real property described in subsection (1) has not commenced within ten (10) years from the effective date of this act, then such property shall revert to the State Board of Trustees for Institutions of Higher Learning. 

     SECTION 2.  This act shall take effect and be in force from and after its passage.
