AN ACT TO AMEND SECTION 47-5-572, MISSISSIPPI CODE OF 1972, TO REMOVE THE REPEALER ON THE PROHIBITION AGAINST PRIVATELY OPERATED PRISONS IN THIS STATE FROM PROCURING GOODS MADE IN PRISONS IN OTHER STATES UNLESS THE GOODS ARE CHEAPER BY A CERTAIN MARGIN THAN GOODS MADE BY MISSISSIPPI PRISON INDUSTRIES CORPORATION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 47-5-572, Mississippi Code of 1972, is amended as follows:

     47-5-572.  (1)  A privately operated correctional facility shall not procure goods, to be used by inmates housed in Mississippi facilities, that have been manufactured using inmates in a correctional system of another state if Mississippi Prison Industries is presently manufacturing the same goods using Mississippi inmates, unless the cost of the goods and services can be procured at a price that is at least thirty percent (30%) less than the cost of the same goods and services provided by Mississippi Prison Industries Corporation.

     (2)  This section shall stand repealed from and after July 1, 2011.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
